Terms of Service

Effective date: March 21, 2026

These terms govern your use of Optelly ("the Service"), operated by Victory Applications LLC ("we", "us", "our"). By using the Service, you agree to these terms.

1. Service Description

Optelly is an AI agent telemetry visualization and analytics platform. It receives OpenTelemetry data from AI coding tools and displays agent activity as animated characters in a 3D office environment.

2. Accounts

You create an account by generating an API key through the Service.
You are responsible for keeping your API key secure. Treat it like a password.
One account per person. Do not share API keys.
You must be at least 16 years old to use the Service.

3. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to reverse engineer, decompile, or extract source code from the Service.
Scrape, crawl, or automated bulk access the Service beyond normal API usage.
Interfere with or disrupt the Service or its infrastructure.
Impersonate another user or provide false identity information.

4. Data Ownership

You own your telemetry data. By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service. We do not claim ownership of your data.

You can export your data at any time (Pro tier) and request deletion of all your data.

5. Billing & Subscriptions

The Service offers a free tier and a paid Pro tier.
Pro subscriptions are billed monthly via Stripe.
You can cancel at any time. Cancellation takes effect at the end of the current billing period.
No refunds for partial months.
We may change pricing with 30 days notice. Existing subscriptions are honored until renewal.

6. Service Availability

We strive for high availability but do not guarantee specific uptime. The Service is provided on a best-effort basis. We may perform maintenance with reasonable notice. The free tier has no SLA.

7. Termination

You may delete your account and data at any time.
We may suspend or terminate accounts that violate these terms, with notice where possible.
Upon termination, your data will be deleted according to the retention policy.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may update these terms from time to time. We will provide at least 30 days notice of material changes via the Service or email. Continued use after changes take effect constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state where Victory Applications LLC is incorporated.
